The Purpose of this agreement is to protect our rights, the rights of Mongaup Technologies, Inc. and it’s D.B.A. Products, DataComputer it’s owners, managers, affiliates, and the rights of our employee as well.
Throughout the course of employment with our organization we will reveal certain trade secrets, presentations, scripts, customer lists, prospect lists, products, techniques, etc. You will agree not share any of your functions for our organization or the functions of the company with anyone that might infringe on our rights. You will also agree not to compete or allow anyone else both knowing and unknowingly to compete with us as a result of your knowledge and experiences here.
You must forfeit any and all monies from any ill-gotten profits to us for violating this agreement. Triple indemnity is required for violating this agreement along with punitive damages, legal expenses and interest consistent with the highest rates allowed by law.
Your customer is the company customer and you are our representative as long as you are employed with us. You are not entitled to sell our customers anything other than through our company and only with our permission. No moonlighting, cross-selling or any other means of contacting our customers for any reason other than to generate sales for our company is accepted, allowed or approved regardless of any statement made to the contrary be it verbal or written. You must also agree not to duplicate or attempt to duplicate any of our products, customer lists, prospect lists, customers, or marketing strategies.
You are responsible for your actions alone and to represent our company in a professional dignified way. We are not responsible for any misstatements on your part or any misrepresentation. Abusing customers, potential customers or fellow employees will result in immediate termination of any agreement. Make sure you have an unlimited calling plan, we are not responsible for your phone bill.
Further to this agreement Mongaup Technologies, Inc. in accordance with its employee handbook, job description, discrimination policies, etc. is allowing and affording you the opportunity to work for our organization as an off-site entity. Any attempt to slander, defame or render any part of any agreement: is acceptance of knowledge of a violation of this confidentiality and employment agreement.
Further to this agreement employees are agreeing not to accept any monetary compensation either directly or indirectly whatsoever from any other organization, entity or person who is considered to be in a business practice competitive to us.
Mongaup Technologies, Inc. is agreeing to pay you 20% of the proceeds received on any sales generated by you. This payment is due to you upon receipt of payment from the customer. Payments are made every two weeks during payroll periods.
At home representatives are entitled to some benefits plans at the off site employees expense.
Every effort will be made by Mongaup Technologies, Inc., it’s Owners, Managers, Technical Support and Staff to ensure the success of all of our representatives, including furnishing viable leads, scripts, trainings, updates, knowledge and assistance.
This agreement is made “At Will” and without reservation. This agreement can be terminated by either party, at any time and for whatever reason without written notice. In the event that Mongaup Technologies, Inc. decides to terminate any of its employees for any reason we agree to pay off any outstanding amounts due to the employee regardless of the reason for termination. Employees and or representatives are not subject to forfeiture of commissions due by their termination of this agreement, unless broken by work from home representative.
